Terms of Service

Important: By using LogInfant, you agree to these Terms of Service. Please read them carefully, especially the sections on Medical Disclaimer and Limitation of Liability.

1. Acceptance of Terms

By accessing or using LogInfant ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old to create an account and use this Service. By using the Service, you represent that you are at least 18 years of age.

2. Description of Service

LogInfant is a baby tracking application that allows parents and caregivers to log and monitor infant-related activities such as feedings, diaper changes, sleep, temperature, medications, and growth measurements. The Service also provides tools such as growth percentile calculators based on World Health Organization (WHO) data.

3. Medical Disclaimer — IMPORTANT

THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION.

LogInfant is designed for informational and organizational purposes only. The information provided by the Service, including but not limited to growth percentile calculations, feeding averages, and trend reports, should NOT be used as a substitute for professional medical advice, diagnosis, or treatment.

ALWAYS seek the advice of your pediatrician, physician, or other qualified healthcare provider with any questions you may have regarding your child's health or medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or calculated using the Service.

If you think your child may have a medical emergency, call your doctor or emergency services immediately. LogInfant does not recommend or endorse any specific tests, physicians, products, procedures, or opinions.

4. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that the information you provide is accurate and current

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Impersonate another person or entity
  • Use the Service to collect data about other users without their consent
  • Resell, sublicense, or commercially exploit the Service without our permission

6. Subscriptions and Payments

6.1 Free Tier

We offer a free tier with limited features. Free tier limitations may change at any time.

6.2 Premium Subscriptions

Premium subscriptions are billed in advance on a monthly or yearly basis. Subscription fees are non-refundable except as required by law or as stated in our refund policy.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation:

  • You will retain Premium access until the end of your current billing period
  • Your account will revert to the free tier after the billing period ends
  • Your data will be preserved (accessible within free tier limits)

6.4 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price increase takes effect.

7. Intellectual Property

The Service, including its design, features, code, and content, is owned by LogInfant and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

You retain ownership of the data you enter into the Service. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOGINFANT, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM ANY CONTENT OR DATA OBTAINED FROM THE SERVICE
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • ANY HEALTH DECISIONS MADE BASED ON INFORMATION FROM THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless LogInfant and its owners, operators, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

11. Third-Party Services

The Service may contain links to or integrate with third-party services (such as Stripe for payments). We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Vilnius, Lithuania.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LogInfant regarding the Service and supersede all prior agreements and understandings.
